The law
South Carolina automatic renewal provisions in service contracts
- Citation: S.C. Code Ann. § 37-6-120 (2024 Act No. 159)
- Effective: 2024-05-20
- Status: In force
- Verified: 2026-10-29, official text read in full (confidence: high)
Consumer service contracts renewing for more than one month and lasting more than six months: 30-60 day pre-deadline notice with the renewal amount and cancellation channels, or the renewal provision is unenforceable.
Scope: Consumer "service contracts" (written contracts for the performance of services over a fixed period or specified duration for personal, family or household purposes) whose automatic renewal provision renews for more than one month and keeps the contract in effect more than six months after it began (§ 37-1-301(31)-(32)). Telecommunications and broadband renewals are excluded. Sanction: the automatic renewal provision is unenforceable.
Requirements
Each row is one obligation in the catalog, in plain English, with the provision it comes from. "Applies when" lists the conditions under which it applies (otherwise it always applies to covered offers). The ids are stable and match the dataset and Checkbox API results.
Before charges (notices and reminders)
| Requirement | Applies when | Effective | Citation |
|---|---|---|---|
Renewal notice 30-60 days before the cancellation deadline, with the renewal amount and how to cancel An automatic renewal provision in a service contract is unenforceable unless the consumer received written or electronic notice 30 to 60 days before the cancellation deadline, conspicuously disclosing: that the contract will renew unless cancelled; the amount charged on renewal; and how to get details of the renewal and cancellation procedure, including a toll-free number, email address, postal address (if billing directly) or another cost-effective, timely and easy-to-use cancellation mechanism. Notice windows
When each notice must be sent. A notice outside its window does not count, so schedule sends against the exact dates.
| Notice | When | Applies when | Citation |

Several states use overlapping windows; one email can often satisfy all of them. See free-trial notices and price increases.
Who can sue, and remedies
Private right of action: Indirectly: private suits go through general consumer-protection law.
Remedy: the automatic-renewal provision is void / unenforceable; whether this "service contract" law reaches digital subscriptions at all is unsettled (open question 16); private enforcement through the state's general consumer-protection (UDAP) statute is inferred, not verified.
Remedy figures come from the cited statutes and from public enforcement records summarized in Checkbox's litigation research; figures from secondary sources are marked "unverified" where they appear.
Check your subscription flow
Checkbox evaluates these requirements automatically: the sign-up page, the emails and the cancellation flow are checked against South Carolina's rules (and every other jurisdiction's) on every check. 2 machine checks cover this page: reminder.annual_renewal, cancel.mechanism_findable.
